Real Estate Genius, LLC (“REG”) does not make recommendations for the purchase or sale of any investment. REG provides a projection of pro forma results based on assumptions provided by User. This analysis provides a starting point for User’s research process, but does not constitute a comprehensive analysis or recommendation of action. For example, this analysis does not take into account unique state or local taxes and laws, and may not take into account current federal taxes and laws. User agrees not to hold REG responsible for any investing decision made as a result of information gleaned from the Real Estate Genius website. REG recommends that User always consult a lawyer and accountant for review of pro forma projections prior to any investing decision. 2. Access to the Real Estate Genius website is granted for as long as User remains an active subscriber. 3. A subscription to the Real Estate Genius website is valid for one party only. Accounts shared by more than one party may be suspended immediately. 4. It is the User’s responsibility to maintain accurate contact information, particularly email address. REG will issue invoices and payment receipts via email, and will periodically make important announcements via email. Through User’s membership, User grants REG the authority to communicate with User via email for these purposes. B. Payment 1. For new subscribers, subscription fees will be charged at time of sign-up. 2. For renewals, User’s subscription fee will automatically be charged to User-provided credit card on the appropriate renewal date. 3. Accounts which do not have an active credit card on file will be suspended as of the renewal date. 4. From time to time, Real Estate Genius, LLC may raise or lower prices. Revised prices will take effect as of User’s next subscription billing date. REG will provide advance notice of revised pricing via the email address User has provided. 5. REG will endeavor to maintain the security of User’s personal information. REG will notify User promptly, via the email address User has provided, if it becomes aware of any security breach which threatens the safety of User’s sensitive data. In the event that User’s personal information is in some way accessed by third-parties, User agrees not to hold REG responsible. C. Refunds and Cancellation 1. User may cancel subscription at any time. The cancellation will be effective at the conclusion of the User’s then-current subscription period. 2. Refunds are not provided for the current subscription month. However, if User chooses to cancel subscription partway through a multi-month subscription, a refund will be provided for all pre-paid months. This refund will be calculated as follows: a) Total amount paid b) LESS appropriate subscription fees for all subscription months completed or begun. (MONTHLY fee applies if less than 3 months were consumed; QUARTERLY fee applies if less than 12 months were consumed). Example: Assume fees are as follows: $15 monthly, $36 quarterly, $108 annual. User ‘A’ pays for an annual membership at $108.00, but cancels after 2 months. Refund provided would be $108.00 (amount paid) - $30.00 (2 x monthly fee) = $78.00. D. Trademarks 1.
